Products and intended use

All products offered by Burly Labs are sold for laboratory research and development use only, to qualified purchasers. They are not drugs, foods, cosmetics or dietary supplements. They are not sold for, and must not be used for, human or animal consumption, clinical use, therapeutic use, diagnostic use, or any application in or on the body of a human or animal. Our FDA Disclaimer forms part of these terms and is incorporated into them by reference.

By placing an order you represent and warrant that:

• you are of legal age in your jurisdiction and have authority to enter into these terms, on your own behalf or on behalf of the organisation you are ordering for;
• you are acquiring the products for laboratory research use only;
• you have the facilities, equipment and trained personnel to receive, handle, store, use and dispose of research chemicals safely and lawfully;
• you will not administer any product to a human or animal, and will not resell, repackage, relabel or supply any product to another person for that purpose; and
• your purchase, possession and intended use of the products comply with every law and regulation that applies to you.

These representations are a condition of sale. Burly Labs may decline, limit, or cancel any order at its discretion, including where we believe an order is inconsistent with these terms, and may require evidence of a purchaser’s qualifications before accepting an order.

Orders, pricing and availability

A product listing is an invitation to place an order, not an offer to sell. A contract is formed only when we accept your order, which we do by dispatching it or by confirming acceptance in writing. Placing an order and receiving an automated acknowledgement does not by itself create a contract.

Prices are stated in US dollars and exclude shipping and any applicable taxes or duties unless stated otherwise. Prices may change at any time before an order is accepted.

We make reasonable efforts to describe products, specifications and availability accurately. Where a price, description or availability is obviously wrong we may correct it, decline the order, or cancel and refund it in full, even after acknowledgement.

All products are subject to availability and to batch release. Where a batch is not released, the listing associated with it is withdrawn.

Payment

Payment is taken at checkout through our payment processor. We do not receive or store complete payment card details. Orders are not prepared for dispatch until payment has cleared in full.

Shipping

Orders placed before 2pm EST on a business day are dispatched the same day. Orders placed after that time, at a weekend or on a public holiday are dispatched the next business day. Dispatch is not delivery: any delivery estimate is an estimate only, and we are not liable for delays caused by a carrier, by customs, or by any other cause outside our reasonable control.

Shipping is charged at the rates shown at checkout. Orders with a value over $250 are shipped free of charge, and where an order qualifies the charge is removed at checkout rather than refunded afterwards.

The purchaser is responsible for confirming that the products may lawfully be imported into, possessed in, and used at the destination, and for any duty, tax, customs charge or licence required there. We do not ship to any jurisdiction where supply would be unlawful, and we may cancel and refund an order rather than ship it into one.

Handling and purchaser responsibility

Responsibility for the safe receipt, handling, storage, use and disposal of the products passes to the purchaser on delivery. Products must be handled only by appropriately trained personnel, in a facility suitable for the purpose, in accordance with the documentation supplied with the batch and with all applicable law.

The purchaser is responsible for keeping the products secure and for preventing access by any person who is not qualified to handle them.

Returns and refunds

Returns and refunds are governed by our Refunds page, which forms part of these terms. In summary: opened products cannot be returned, because their storage history and chain of custody can no longer be verified; unopened and unused products may be returned within the stated window; and anything that arrives damaged, incorrect or missing will be replaced or refunded.

Warranty and disclaimer of warranties

We warrant that, at the time of dispatch, each product conforms to the specification set out in the certificate of analysis supplied for that batch. This is the only warranty we give.

To the maximum extent permitted by applicable law, all other warranties, representations and conditions, whether express or implied, statutory or otherwise, are excluded. That includes any implied warranty of merchantability, satisfactory quality, or fitness for a particular purpose.

Research materials are experimental in nature. The purchaser is solely responsible for determining whether a product is suitable for its intended research application, and for validating it for that purpose. We do not advise on experimental design or intended use and we make no claim about what any product does.

Limitation of liability

To the maximum extent permitted by applicable law, the total aggregate liability of Burly Labs arising out of or in connection with any product or order, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the price paid for the product giving rise to the claim.

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, revenue, anticipated savings, data, research results, grant funding, or business interruption, however arising.

We are not liable for any loss or damage arising from use of a product in a manner inconsistent with these terms, including any administration of a product to a human or animal.

Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

Indemnity

You agree to indemnify and hold harmless Burly Labs, its officers, employees and agents against any claim, demand, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of or in connection with: (a) your receipt, handling, storage, use or disposal of any product; (b) any administration of a product to a human or animal, whether by you or by anyone who obtained it from you; (c) your breach of these terms or of any representation you gave when ordering; or (d) your breach of any applicable law or regulation.

Compliance and restricted supply

You may not export, re-export, resell or otherwise transfer any product in breach of any applicable export control, sanctions, or controlled substance law. You may not supply any product to a person you know or suspect intends to administer it to a human or animal.

We may suspend or terminate an account, decline future orders, and report an order to the relevant authority where we believe these terms or any applicable law have been breached.

Changes to these terms

We may amend these terms at any time. The version published on this page at the time you place an order is the version that governs that order. Continuing to use the website after a change means you accept the amended terms.

If any provision of these terms is found to be unenforceable, the remainder continues in full force, and the unenforceable provision applies to the greatest extent permitted.
